What is an IVO, Family Intervention Order?

A Family Violence Intervention Order grants the affected family member experiencing family violence immediate short-term and long-term protection.
Commonly, a IVO will:
  • Prohibit the respondent from committing family violence against the protected person;
  • Prevent the respondent from being in close proximity to the protected persons home;
  • Restrict the respondent’s access to any premises and/or a specified area;
  • Prohibit the respondent from contacting the protected person.
An interim order may be granted If a Magistrate is satisfied on the balance of probabilities that the affected family member’s personal safety, property or the affected family member’s children are at risk pending a decisioning about the final order.

Can I apply for a IVO, Family Violence Intervention order?

Any family member experiencing violence can apply for and obtain a IVO. The definition of family member includes:
  • a current or former spouse;
  • a domestic partner;
  • a person with whom the respondent has had an intimate relationship (sexual or not);
  • same-sex relationships;
  • Immediate and extended family (parents, children etc.); and
  • Platonic friends.

How long does an IVO order last?

A Family Violence Intervention Order can be for an indefinite period or for a specified time. Generally, Orders will last for one to two years. If the respondent named on the order is a child, the final Order must not remain in force for more than 12 months (unless there are exceptional circumstances).
